DearSenda Terms of Service

1. Agreement to Terms

By using DearSenda, creating a request, paying for a gift or interacting with our bot, you agree to these Terms. If you do not agree, please do not use DearSenda.

These Terms form a binding agreement between you (“you”, “sender”, “user”) and DearSenda (“we”, “us”, “our”).

2. What DearSenda does

DearSenda is a gift coordination service. We help you organise surprise gifts, flowers, money bouquets and care packages for your loved ones, starting with receivers in the United States and expanding to other regions over time.

We work with trusted vendors, couriers and partners to source, package and deliver gifts on your behalf. While we coordinate the process, we may not be the physical courier or vendor fulfilling every part of the request.

3. Eligibility & acceptable use

By using DearSenda, you confirm that:

• You are at least 18 years old, or legally able to enter into a binding contract.
• You will provide accurate and complete information about yourself, the receiver and the delivery address.
• You will not use DearSenda for any illegal, abusive or harmful purposes (including harassment, money laundering or shipping prohibited items).

4. Requests, pricing & currency

When you submit a request on DearSenda, you’ll see an estimated or fixed price in Nigerian Naira (NGN) or another supported currency. Final pricing may depend on:

• The gift type and size.
• The receiver’s city/state and exact delivery address.
• Packaging style, add-ons and delivery options.
• Currency fluctuations and partner charges.

In many cases, you will see a final charge amount at checkout. In some scenarios (for complex or customised requests), our team may confirm a revised amount with you before proceeding.

5. Payments, confirmations & receipts

Payments are processed by third-party payment providers (such as Korapay). When you pay for a DearSenda request:

• You authorise us and our payment partners to charge your chosen payment method.
• You are responsible for ensuring your payment details are correct.
• Once payment is confirmed, we will send you a reference ID (e.g. DS-XXXX) via email and/or Telegram if linked.

If payment fails, we may ask you to try again or use a different method. We may cancel or delay requests that are unpaid or flagged as suspicious by our payment partners.

6. Delivery, timelines & limitations

We work hard to meet your preferred timelines and dates, but exact delivery times may depend on:

• Receiver location and address accuracy.
• Local partner availability and cut-off times.
• Weather, public holidays and other external factors.

Any delivery estimates (e.g. “1 day”, “1–3 days”) are best-effort and not absolute guarantees. If we expect a significant delay or issue, we’ll try to inform you via email or Telegram where possible.

7. Cancellations, changes & refunds

Because many DearSenda requests involve perishable items or time-sensitive deliveries, cancellations and refunds may be limited once processing has begun.

In general:

• If you contact us very early and we have not yet committed costs to vendors or delivery, we may be able to cancel and refund partially/fully at our discretion.
• If we have already purchased items or arranged delivery, refunds are usually not possible, but we may work with you to adjust the request where practical.
• If a failure is clearly due to our partners or internal error, we may offer a partial or full refund, credit or re-delivery, depending on the situation.

Each case is reviewed individually. To request a cancellation or refund, contact our support via email or Telegram with your DearSenda reference ID.

8. Prohibited uses

You agree not to use DearSenda to:

• Send illegal, dangerous or prohibited items.
• Harass, threaten, abuse or stalk any person.
• Commit fraud, money laundering or other unlawful activities.
• Interfere with or disrupt our services or infrastructure.

We may suspend or terminate your access if we detect or reasonably suspect any prohibited use.

9. Intellectual property

The DearSenda brand, logo, website design, content and internal tools are protected by intellectual property rights. You may not copy, resell, redistribute or create derivative works from our platform without our permission.

10. Limitation of liability

To the maximum extent permitted by law, DearSenda is not liable for any:

• Indirect, incidental or consequential damages.
• Loss of profits, goodwill or data.
• Issues caused by inaccurate information you provide (such as wrong address, receiver unavailability, etc.).

Our total liability for any claim relating to a specific DearSenda request will not exceed the amount you paid for that request.

11. Changes to DearSenda

We may modify, pause or discontinue parts of DearSenda at any time (for example, to expand to new locations, improve the experience or address security issues).

Where reasonable, we will try to minimise disruption to ongoing requests and inform you about major changes that affect you.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page and, where appropriate, notify you via email or an in-product notice.

Your continued use of DearSenda after changes take effect means you accept the updated Terms.
